License Under Private Security Agencies Regulation Act, 2005

Before any person starts a private security business in India, he should obtain PSARA License. The private security agencies’ operations are governed by The Private Security Agencies Regulation Act, 2005, enforced by the Department of Internal Security of the Ministry of Home Affairs, Government of India. After the enactment of the PSARA (Act), a security agency must obtain a Licence from the State Controlling Authority Concerned before commencing the business. The application for PSARA License to start a private security agency is made to the state’s competent authority. The PSARA License is issued to operate in one or more districts of a particular state or for the entire state. 

Eligibility

An application for the issue of a license under this Act shall only be considered from a person after due verification of his antecedents. Any person, whether individual or a legal entity is eligible for making an application for the PSARA License. The model can be one of the following:

  1. OPC
  2. Sole proprietorship
  3. Partnership Firm
  4. LLP
  5. Private Limited Company
  6. NGO

Eligibility Criteria for Directors or Principal Officers to acquire PSARA License:

  1. Citizen of India;
  2. Never engaged in any offense related to promotion, formation, and management of the company by order of the court;
  3. Financially competent for business operations; and
  4. Non-Conviction by the court for any crime.

Eligibility Criteria for Security Guards to acquire PSARA License:

  1. An Indian citizen or a citizen of such other country as the Central Government may, by notification in the Official Gazette, specify; 
  2. Has completed eighteen years of age but has not attained the age of sixty-five years; 
  3. Satisfies the agency about his character and antecedents in such manner as may be prescribed; 
  4. Has completed the prescribed security training successfully; and
  5. Fulfills such physical standards and other conditions as may be prescribed;

MOU With Training Institute

The applicant for a PSARA Licence must enter into an MOU with a training institute or an organization as approved by the state controlling authority for imparting training to the security guards. There is relaxation to the training requirements for ex-servicemen.

6. Rental Agreement in the name of the entity

7. Ownership proof of the premises ie. Latest electricity bill/property tax paid receipt/ sale deed (property papers) of the premises

8. MOU from training Institute

9. Affidavits

10. Guards Photo

11. Photograph of the office or establishment

12. Shop Act registration Certificate

13. PF and ESIC certificate (if any)

14. GST Certificate

Limited Liability Partnership

1. Certificate of Incorporation (COI)

2. LLP Agreement

3. Pan Card Copy of entity

4. Each partner documents like, passport size Photograph, Pan card, Aadhar card, Address proof, Police verification certificate, Educational documents

5. Rental Agreement in the name of the entity

6. Ownership proof of the premises ie. Latest electricity bill/property tax paid receipt/ sale deed (property papers) of the premises

7. MOU from training Institute

9. Guards Photo in uniform

10. Establishment photograph

11. Shop Act registration Certificate

Partnership Firm

1. Partnership Deed
